1. Acceptance of Terms
By accessing or using the Hanki platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Service.
2. Description of Service
Hanki provides a digital identity and tap-to-connect networking platform that enables users to share contact information, manage digital business cards, and track interactions through NFC-enabled physical cards ("Hankies").
3. User Accounts
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorised use.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Impersonate another person or entity
- Upload or transmit viruses, malware, or other harmful code
- Attempt to gain unauthorised access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Harvest or collect user data without consent
5. Intellectual Property
All content, trademarks, logos, and intellectual property displayed on the Service are owned by or licensed to Hanki. You may not reproduce, distribute, or create derivative works without our prior written consent.
6. User Content
You retain ownership of content you upload to Hanki. By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content solely for the purpose of providing the Service.
7. Subscriptions and Payments
Certain features require a paid subscription. Payments are processed through our third-party payment provider. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are provided in accordance with applicable consumer protection laws.
8. Physical Products
Hanki NFC cards are physical products subject to separate shipping and return policies. Defective cards will be replaced free of charge within 30 days of delivery.
9. Limitation of Liability
To the maximum extent permitted by law, Hanki shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the preceding 12 months.
10. Termination
We may suspend or terminate your account at any time if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the profile settings.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via the Service or email. Continued use after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
